Terms & Conditions

Last Updated: January 1, 2025

1. Introduction

Welcome to Wok & Roll ("we," "us," "our"). We are an online food service specializing in authentic Chinese cuisine for delivery. These Terms & Conditions ("Terms") form a legally binding agreement between you ("the Customer," "you") and Wok & Roll. These Terms govern your use of our website (the "Site"), our online ordering platform, and the fulfillment of any food order. By placing an order with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

To place an order with Wok & Roll, you must be at least 18 years of age and possess the legal authority to enter into a binding contract. You affirm that all information provided to us during the ordering process is true, accurate, and complete.

3. Customer Responsibilities

You, the Customer, agree to provide current, complete, and accurate information for your order. This includes, but is not limited to, your full name, a valid phone number, a correct delivery address, and accurate payment information. It is your sole responsibility to clearly and accurately communicate any dietary restrictions or allergies in the designated section for each menu item during the ordering process. Wok & Roll is not liable for any adverse reactions due to undisclosed allergies.

Furthermore, it is your responsibility to be available to receive the delivery at the address provided during the estimated delivery window. We are not responsible for any degradation in food quality or loss if you are unavailable to accept the delivery at the designated time and location.

4. Orders, Menu Availability & Substitutions

Placing an order through our Site constitutes an offer to purchase our products. An order is considered confirmed only when you have received a formal order confirmation email from Wok & Roll. While we strive to keep our menu updated, all items are subject to availability. We reserve the right to substitute ingredients or minor components of a dish due to supply chain issues without prior notice. If a main component of a dish is unavailable, we will attempt to contact you to offer a suitable replacement or a refund for that item.

5. Pricing and Payment

All prices are quoted in the currency displayed on the Site and are subject to applicable taxes and delivery fees, which will be clearly stated at checkout. Full payment is required at the time of ordering via our secure third-party payment gateways. Prices for our products are subject to change without notice, but the price for your order is fixed once it has been confirmed.

6. Delivery

All delivery times provided by us are estimates. While we strive to meet these estimates, we are not liable for any delays caused by factors beyond our reasonable control, such as severe weather, traffic conditions, or other unforeseen events. Our obligation is to deliver your order to the address you provide. If our delivery team is unable to deliver the order due to an incorrect address or the customer's unavailability, no refund will be issued. Our delivery service is limited to the delivery zone specified on our Site.

7. Cancellations, Refunds, and Changes Policy

Due to the immediate nature of food preparation, all cancellation or change requests must be made by phone within 5 minutes of placing the order. We cannot guarantee that requests made after this window can be accommodated.

8. Intellectual Property

The "Wok & Roll" name, logo, website content, text, photography, recipes, menu descriptions, and all other brand materials are the exclusive intellectual property of Wok & Roll. We grant you a limited, non-transferable license to access our Site for personal, non-commercial use to place an order. Any unauthorized use, reproduction, or distribution of our brand assets or content is strictly prohibited.

9. Limitation of Liability

To the fullest extent permitted by law, our liability for any claim arising out of your order or use of our services is limited to the total cost of the order you have purchased from us. We are not liable for any indirect, incidental, or consequential damages. We are not liable for any adverse health effects (including allergic reactions) resulting from a customer's failure to disclose relevant dietary information. We are not responsible for events of Force Majeure, including but not limited to acts of God, power outages, equipment failure, or other circumstances beyond our reasonable control that may disrupt service.

10. Applicable Law

These Terms are governed by and construed in accordance with the laws of the state and country in which Wok & Roll's primary kitchen of operations is located. In the event of any dispute arising from these Terms or our services, the courts of that jurisdiction shall have exclusive jurisdiction.

11. Policy Updates

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. The revised Terms will be posted on our Site, and the "Last Updated" date will be amended. Your continued use of our services or placement of an order after any such changes are posted constitutes your acceptance of the new Terms.
